LEGALPARIHAR TERMS AND CONDITIONS OF USE AND SERVICE

These Terms and Conditions ("Terms", "Terms and Conditions" or "Agreement") govern the access to and use of the website LegalParihar.in, together with the ordering and provision of services through the website, online communication channels, applications, forms, payment interfaces and other digital or physical channels operated or controlled by LegalParihar.

LegalParihar is operated as a proprietorship business and provides online legal documentation, drafting, document-processing, coordination and facilitation services.

For the purposes of these Terms, "LegalParihar", "we", "us" or "our" means the proprietor/business operating LegalParihar, and "User", "Customer", "you" or "your" means any person accessing the website or requesting, purchasing or receiving any service from LegalParihar.

By accessing the website, submitting an enquiry, placing an order, making a payment, uploading documents, electronically accepting these Terms, or otherwise using any LegalParihar service, you acknowledge that you have read, understood and agreed to be bound by these Terms.

If you do not agree with these Terms, you must not use the website or place an order for any service.

1. NATURE OF LEGALPARIHAR'S BUSINESS

1.1 LegalParihar is an online legal documentation and service-facilitation business.

1.2 Depending upon the nature of the service requested, LegalParihar may:

  • perform certain services directly, including drafting, document preparation, document formatting, compilation, processing, coordination and related administrative services;
  • facilitate or coordinate services provided by independent third-party professionals or service providers;
  • procure or arrange government or statutory instruments, including e-stamp or stamping-related requirements, where available and permissible;
  • coordinate notarial, attestation, electronic-signature, courier, verification or other services through independent service providers; and
  • provide administrative assistance in bringing together the different components required to complete a customer's requested documentation.

1.3 The specific services included in a particular order shall depend upon the service selected or requested by the Customer and shall be communicated or displayed to the Customer before or at the time of order confirmation, wherever reasonably practicable.

1.4 LegalParihar does not represent that every component of a particular service is performed directly by LegalParihar. Where an independent professional, government-authorized provider, notary, stamp vendor, electronic-signature provider, advocate or other third-party service provider is involved, that person or entity remains independently responsible for the professional, statutory or technical function performed by them, subject to applicable law.

2. NO GENERAL AGENCY OR EMPLOYMENT RELATIONSHIP

2.1 Nothing in these Terms shall be construed as creating a general partnership, employment relationship, joint venture or unrestricted agency relationship between the Customer and LegalParihar.

2.2 Where a particular transaction requires LegalParihar to procure an item, arrange a service or make a payment on behalf of the Customer, the Customer authorizes LegalParihar to undertake that specific activity for the limited purpose for which the authorization is given.

2.3 Such limited authorization does not make LegalParihar the legal, professional or statutory provider of a service that is independently performed by a notary, advocate, stamp authority/vendor, electronic-signature provider or other independent provider.

2.4 The legal and professional responsibility for an independent professional service remains with the relevant professional or service provider to the extent prescribed by applicable law.

3. SERVICES PERFORMED DIRECTLY BY LEGALPARIHAR

3.1 Depending on the service ordered, LegalParihar may directly provide services including:

  • drafting of agreements, affidavits, declarations and other documents;
  • preparation and formatting of documents based on information and instructions supplied by the Customer;
  • document compilation and processing;
  • administrative and procedural coordination;
  • coordination of stamping, notarization, electronic-signature and related processes;
  • document submission or processing assistance where expressly included in the relevant service; and
  • other documentation or administrative services communicated to the Customer.

3.2 The scope of a particular service shall be determined by the applicable service description, quotation, order confirmation, invoice, communication or other transaction record.

3.3 Unless expressly stated otherwise, LegalParihar does not provide legal advice, legal opinions, legal representation or advocacy merely by providing drafting, documentation or facilitation services.

4. INDEPENDENT THIRD-PARTY SERVICE PROVIDERS

4.1 LegalParihar may, depending upon the Customer's requirements, coordinate with independent third-party service providers, including:

  • advocates and legal professionals;
  • notaries;
  • authorized stamp vendors or stamping authorities;
  • electronic-signature service providers;
  • identity or verification service providers;
  • f. courier or delivery providers; and
  • other persons or entities required for completion of a particular service.

4.2 Such third-party providers are independent persons or entities and are not employees, partners or general agents of LegalParihar solely by reason of their participation in a Customer's order.

4.3 The availability, acceptance, processing time, professional decision, technical functionality and outcome of a third-party service may depend upon the relevant provider and applicable law.

4.4 LegalParihar may communicate with and share information with such third-party providers to the extent reasonably necessary to process the Customer's order and subject to applicable privacy and data-protection requirements.

4.5 Where a third-party provider independently performs a professional or statutory function, LegalParihar does not assume responsibility for matters that are exclusively within that provider's professional or statutory authority.

5. CUSTOMER INSTRUCTIONS, INFORMATION AND DOCUMENTS

5.1 The Customer is responsible for providing complete, accurate and truthful information and documents required for the requested service.

5.2 LegalParihar may rely upon the information and documents supplied by the Customer unless there is an apparent reason to question their authenticity, completeness or accuracy.

5.3 The Customer shall promptly inform LegalParihar of any error, omission, change of circumstances or change in instructions.

5.4 LegalParihar shall not be responsible for consequences arising primarily from inaccurate, incomplete, misleading, outdated or unauthorized information supplied by the Customer.

5.5 The Customer represents that the Customer has the authority to provide all documents and information submitted to LegalParihar and to instruct LegalParihar to process the requested service.

5.6 Where documents or information belong to another person, the Customer shall be responsible for obtaining the necessary authority or consent before submitting them.

6. DOCUMENT DRAFTING AND CUSTOMER APPROVAL

6.1 Where LegalParihar prepares a document based on information or instructions supplied by the Customer, the Customer shall review the draft carefully before approving it for execution, stamping, notarization, attestation, electronic signing or submission.

6.2 The Customer is responsible for confirming names, identities, addresses, dates, amounts, property details, identification details, contractual terms, factual statements and other information contained in the document.

6.3 Where the Customer approves a draft, electronically or otherwise, LegalParihar may proceed with the subsequent processing requested by the Customer.

6.4 Changes requested after stamping, notarization, attestation, execution or other finalization may require preparation and processing of a new document and may result in additional charges.

6.5 LegalParihar shall not be responsible for an error that arises solely from incorrect or incomplete information supplied or approved by the Customer.

7. LEGAL ADVICE AND PROFESSIONAL SERVICES

7.1 LegalParihar is not a law firm merely by providing online documentation, drafting or facilitation services.

7.2 Unless expressly provided by an independently enrolled advocate or other duly authorized professional, LegalParihar does not provide legal opinions, legal advice, representation before courts, tribunals or authorities, advocacy, professional legal strategy, or an opinion on the legal merits of a Customer's particular matter.

7.3 Where an advocate or other independent professional is engaged, the professional relationship concerning that professional service shall be between the Customer and the relevant professional, subject to applicable law.

7.4 Customers requiring legal advice are encouraged to obtain independent advice from a suitably qualified advocate or legal professional.

8. NOTARIZATION AND ATTESTATION

8.1 LegalParihar may facilitate notarization or attestation through an independent notary or other authorized professional where such service is available and legally permissible.

8.2 The notary or authorized professional remains independently responsible for determining whether the document and circumstances satisfy the applicable requirements for the requested notarial or attestation act.

8.3 The notary may request additional documents, identification, declarations, verification, appearance, video interaction or other information before performing the relevant act.

8.4 LegalParihar cannot guarantee that a notary will notarize or attest a particular document.

8.5 Where an online, video-based or remote process is offered, the Customer acknowledges that the availability and legal or administrative acceptability of such process may depend upon the

applicable document, jurisdiction, notary, authority, service provider and prevailing law or rules.

8.6 LegalParihar does not represent or warrant that a document that has been notarized, attested, electronically signed or processed through a remote or online procedure will necessarily be accepted by every court, government department, private organization, financial institution, registrar, employer, embassy, consulate or other authority.

8.7 Customers are responsible for confirming the specific acceptance requirements of the authority or organization before relying upon or submitting a document.

9. ELECTRONIC SIGNATURE AND DIGITAL PROCESSING

9.1 LegalParihar may facilitate electronic-signature or digital-signature processing through an independent electronic-signature service provider.

9.2 Electronic-signature processing may be subject to identity verification, authentication, technical requirements, service-provider policies and applicable law.

9.3 Where a particular service package includes electronic-signature processing, the applicable inclusions, limits and additional charges, if any, shall be disclosed at the time of order.

9.4 LegalParihar does not guarantee that an electronically signed document will be accepted by every authority or organization for every purpose.

9.5 The Customer shall ensure that the Customer is legally entitled to sign or authorize the relevant document.

10. E-STAMP, STAMP DUTY AND STAMPING SERVICES

10.1 LegalParihar may facilitate procurement of e-stamp or other stamping instruments through applicable government-authorized portals, authorities or authorized vendors, based on the Customer's instructions.

10.2 LegalParihar is not itself the government authority issuing statutory stamp duty unless expressly authorized under applicable law.

10.3 Applicable stamp duty, stamping requirements, denomination, instrument type and execution requirements may vary depending upon the State, document, transaction and applicable law.

10.4 The Customer is responsible for providing accurate information required for stamping.

10.5 LegalParihar shall not be responsible for consequences arising from incorrect information supplied by the Customer or from a subsequent change in law, government procedure or authority requirement.

10.6 An e-stamp or other stamping instrument must be used only for the purpose and in the manner permitted by applicable law.

10.7 The Customer shall not duplicate, misuse, alter, reproduce or unlawfully reuse any e-stamp or stamping instrument.

10.8 Where a physical copy is not required to be delivered to the Customer, LegalParihar may retain, archive or securely dispose of physical copies in accordance with applicable law, operational requirements and its record-retention policy.

11. THIRD-PARTY, GOVERNMENT AND STATUTORY CHARGES

11.1 Certain services may require payment of government duties, statutory charges or charges payable to independent third-party providers.

11.2 Such amounts may include stamp duty, e-stamp or stamping charges, notarial charges, electronic-signature charges, professional charges payable to independent professionals, courier or delivery charges, verification charges and other applicable third-party or statutory charges.

11.3 Depending upon the nature of the transaction, LegalParihar may:

  • charge its own service fee;
  • collect third-party or statutory amounts for onward payment or procurement;
  • pay or procure certain amounts on behalf of the Customer pursuant to the Customer's authorization; or
  • use a combination of the above arrangements.

11.4 The applicable pricing structure shall be communicated or displayed to the Customer at or before order confirmation, wherever reasonably practicable.

11.5 Where LegalParihar makes a payment or incurs expenditure on behalf of the Customer, the legal and tax treatment of that amount shall depend upon the actual circumstances and documentation of the transaction.

11.6 Where the conditions prescribed under applicable law for treatment as a pure-agent expenditure are satisfied, the relevant amount may be separately identified and recovered at actual cost.

11.7 Merely describing an amount as a reimbursement, pass-through amount, third-party charge or pure-agent amount shall not by itself determine its legal or tax treatment.

11.8 LegalParihar may maintain records of relevant third-party invoices, receipts, payment confirmations or other evidence for accounting, regulatory, audit and dispute-resolution purposes.

12. PRICING, TAXES AND PAYMENTS

12.1 Prices for LegalParihar services may vary depending upon the type, complexity, scope, urgency and requirements of the requested service.

12.2 The applicable price for a particular service shall be communicated or displayed to the Customer before order confirmation, wherever reasonably practicable.

12.3 A particular service may comprise LegalParihar's own service fees, government or statutory charges, third-party charges, delivery or courier charges, applicable taxes and/or other charges expressly disclosed to the Customer.

12.4 Applicable taxes shall be charged, collected and accounted for in accordance with the tax status of LegalParihar and applicable law.

12.5 LegalParihar shall not represent or collect any amount specifically as GST unless legally entitled or required to do so.

12.6 Government duties and statutory charges are distinct from taxes charged on LegalParihar's own services.

12.7 The Customer shall complete payment using the payment methods made available by LegalParihar.

12.8 LegalParihar may use payment gateways, banks or other authorized payment intermediaries to process payments.

12.9 LegalParihar shall not be responsible for delays caused by payment gateways, banking systems or other external payment infrastructure beyond its reasonable control.

13. ORDER ACCEPTANCE AND SERVICE COMMENCEMENT

13.1 Submission of an order or payment does not necessarily constitute unconditional acceptance of the order.

13.2 An order shall be treated as accepted when LegalParihar confirms acceptance or commences processing, subject to these Terms.

13.3 LegalParihar may decline or cancel a request where the requested service cannot lawfully be provided, required information or documentation is unavailable, a third-party service provider is unavailable, the requested document or transaction appears fraudulent, unlawful or misleading, the Customer does not satisfy applicable requirements, technical or operational circumstances prevent completion, or other legitimate circumstances make processing impracticable.

13.4 Where an order is cancelled by LegalParihar before material processing has commenced, the Customer may be eligible for a refund in accordance with the applicable refund policy and subject to amounts already paid or committed to third parties.

14. CANCELLATION, REFUND AND REWORK

14.1 Refund eligibility shall depend upon the nature and stage of the service.

14.2 Amounts already paid to government authorities or third-party service providers may be non-refundable where the relevant authority or provider does not permit refund, subject to

applicable law.

14.3 Where LegalParihar has already commenced drafting, processing, coordination or other work specifically for the Customer, the amount attributable to work already performed may be non-refundable, subject to applicable law and the applicable refund policy.

14.4 Where a service cannot be completed because of a third-party provider's refusal, unavailability or decision, LegalParihar may, where reasonably possible, offer an alternative process or refund the portion of the amount that has not been earned or committed, subject to applicable law and the applicable service/refund policy.

14.5 No provision of these Terms shall be interpreted as excluding any refund, remedy or statutory right that cannot lawfully be excluded.

14.6 A Customer shall not be entitled to a refund merely because an authority subsequently refuses to accept a document where LegalParihar correctly performed the contracted service and the refusal arises from an authority-specific requirement, change in policy, Customer-supplied information or a matter outside LegalParihar's reasonable control.

14.7 Where a document must be redrafted or reprocessed because of incorrect information supplied by the Customer or because the Customer changes the instructions after approval, additional charges may apply.

15. CUSTOMER RESPONSIBILITIES

The Customer agrees to provide accurate and complete information; provide genuine and valid identification and supporting documents; not submit forged, fabricated or misleading documents; not use LegalParihar services for unlawful purposes; review and approve documents before execution or final processing; comply with instructions issued by relevant authorities or thirdparty providers; make required payments within the prescribed time; maintain confidentiality of OTPs, passwords and authentication credentials; not impersonate another person; and not instruct LegalParihar to undertake any activity that would violate applicable law.

16. ACCEPTABILITY AND USE OF COMPLETED DOCUMENTS

16.1 LegalParihar facilitates document preparation and related processing based upon the Customer's instructions and the applicable service requested.

16.2 Completion of a LegalParihar service does not constitute a guarantee that the resulting document will be accepted by any particular authority, institution or third party.

16.3 Acceptance may depend upon applicable law, document format, stamp duty, execution requirements, notarization requirements, electronic-signature requirements, jurisdiction, internal policies of the receiving authority, and facts and circumstances beyond LegalParihar's control.

16.4 The Customer should verify specific submission and acceptance requirements with the relevant authority before ordering or relying upon a document where such requirements are material.

17. INDEPENDENT ADVOCATE DIRECTORY / LAWYERS NETWORK

17.1 LegalParihar may maintain a directory or network containing information about independent advocates or legal professionals.

17.2 Listing in such directory does not make an advocate an employee, partner or representative of LegalParihar.

17.3 Unless expressly stated otherwise, LegalParihar does not itself provide the professional legal advice or representation of an advocate listed in the directory.

17.4 Users should independently verify the identity, enrolment, credentials, experience, availability and suitability of any advocate before engaging the advocate.

17.5 Any professional engagement between a User and an independent advocate shall be governed by the terms agreed between those parties and applicable professional rules.

17.6 LegalParihar does not guarantee the outcome, quality, advice, conduct, availability or professional performance of an independent advocate.

17.7 LegalParihar may remove, suspend or modify a directory listing where it considers this reasonably necessary.

18. PRIVACY AND PROCESSING OF PERSONAL INFORMATION

18.1 LegalParihar may collect and process personal information reasonably necessary to provide requested services.

18.2 Depending upon the service, such information may include identity details, contact information, address, documents, photographs, signatures and information required by government authorities or independent service providers.

18.3 By requesting a service, the Customer authorizes LegalParihar to process and share relevant information with service providers, notaries, stamp vendors, electronic-signature providers, payment processors, couriers, government authorities and other persons where reasonably necessary to provide the requested service or comply with law.

18.4 LegalParihar shall process personal information in accordance with its Privacy Policy and applicable data-protection and privacy laws.

18.5 The Customer shall not provide personal information belonging to another person unless the Customer is lawfully authorized to do so.

18.6 The Customer should review the LegalParihar Privacy Policy before using services involving personal or sensitive documentation.

19. INTELLECTUAL PROPERTY

19.1 Unless otherwise stated, the website, branding, logos, designs, software, source code, written content, graphics, templates, databases, user interfaces, workflows and other materials made available by LegalParihar are owned by or licensed to LegalParihar.

19.2 The Customer receives only the limited right necessary to use the completed document or service for its intended lawful purpose.

19.3 No Customer may reproduce, resell, commercially exploit, distribute, copy or modify LegalParihar's proprietary website content, templates, software or branding without prior written authorization, except to the extent permitted by law.

19.4 Documents specifically prepared for a Customer may be used by that Customer for the purpose for which they were prepared, subject to any third-party rights and applicable law.

20. WEBSITE CONTENT AND GENERAL INFORMATION

20.1 Information published on LegalParihar.in, including blogs, guides, FAQs, articles, examples, templates and automated tools, is provided for general informational purposes.

20.2 Such content should not be treated as a substitute for professional legal advice.

20.3 Laws, regulations, procedures, government requirements and administrative practices may change.

20.4 LegalParihar does not guarantee that every general informational resource will remain current after publication.

20.5 Users should obtain professional advice where their particular circumstances require legal interpretation or professional judgment.

21. PROHIBITED USE

The Customer shall not use LegalParihar or its services to violate any applicable law; create or process fraudulent or forged documents; impersonate another person; submit false information; infringe intellectual-property rights; compromise another person's privacy; upload malware or malicious code; interfere with website security or operations; attempt unauthorized access to LegalParihar systems; abuse payment or refund mechanisms; or facilitate any unlawful transaction.

LegalParihar may suspend, reject or terminate services where there is reasonable suspicion of prohibited or unlawful activity, subject to applicable law.

22. THIRD-PARTY WEBSITES AND SERVICES

22.1 LegalParihar may use or link to third-party websites, applications, payment gateways or service-provider systems.

22.2 LegalParihar does not control the policies, availability, security or functionality of independent third-party systems.

22.3 Use of such systems may be subject to the third party's own terms, privacy policy and service conditions.

22.4 LegalParihar shall not be responsible for a third party's independent failure, outage, policy change or unauthorized act except to the extent liability cannot lawfully be excluded.

23. LIMITATION OF LIABILITY

23.1 To the maximum extent permitted by applicable law, LegalParihar shall not be liable for indirect, incidental, special, exemplary or consequential loss arising from rejection of a document by an authority; delay caused by an independent service provider; notarial or professional decisions made by an independent professional; government processing delays; payment gateway or technical failures outside LegalParihar's reasonable control; incorrect information supplied by the Customer; changes in law, government procedure or authority requirements; or failure of a third-party service provider.

23.2 Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.

23.3 Nothing in these Terms shall prevent a Customer from exercising any statutory right or remedy that cannot lawfully be waived.

23.4 Where LegalParihar is responsible for a failure in a service directly provided by LegalParihar, the Customer's remedies shall be determined in accordance with the nature of the service, applicable law and the circumstances of the case.

24. INDEMNIFICATION

To the extent permitted by applicable law, the Customer agrees to indemnify and hold harmless LegalParihar, its proprietor, employees and authorized personnel against claims, losses, liabilities, costs or expenses arising from false, fraudulent or misleading information supplied by the Customer; unauthorized use of another person's identity or documents; unlawful use of LegalParihar services; infringement of third-party rights by materials supplied by the Customer; or breach of these Terms by the Customer.

This clause shall not apply to the extent that the relevant loss was caused by LegalParihar's own fraud, wilful misconduct or liability that cannot lawfully be excluded.

25. ELECTRONIC COMMUNICATIONS AND CONSENT

25.1 The Customer consents to receive communications electronically, including order confirmations, service updates, payment confirmations, invoices and receipts, requests for information, document approvals, service-provider coordination messages, policy updates, and grievance or legal communications where legally permissible.

25.2 Electronic records, confirmations and communications may be retained as evidence of the relevant transaction, subject to applicable law.

25.3 The Customer is responsible for maintaining access to the email address and mobile number supplied to LegalParihar.

26. FORCE MAJEURE

LegalParihar shall not be responsible for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, government restrictions, strikes, civil unrest, war or similar events, pandemics or public-health emergencies, internet or telecommunications failure, power failure, cyber incidents affecting third-party infrastructure, payment-system failure, government portal outages, third-party provider outages, or other events beyond reasonable control.

LegalParihar shall use reasonable efforts to resume affected services when circumstances permit.

27. DISPUTE RESOLUTION AND GOVERNING LAW

27.1 These Terms shall be governed by the laws of India.

27.2 The parties shall initially attempt to resolve any dispute through good-faith communication and the LegalParihar grievance process.

27.3 Where legally permissible and where the dispute is capable of being referred to arbitration, the parties may mutually agree to refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996.

27.4 The proposed seat of arbitration shall be Satna, Madhya Pradesh, India, unless otherwise agreed or determined by a competent authority in accordance with applicable law.

27.5 Nothing in this clause shall prevent a consumer or other person from approaching a statutory authority, consumer commission, court or other forum where such right cannot lawfully be excluded or restricted by contract.

27.6 Nothing in these Terms shall be interpreted as requiring arbitration where applicable law confers a non-waivable statutory remedy or jurisdiction upon a particular authority or forum.

LegalParihar shall make reasonable efforts to acknowledge and address grievances in accordance with applicable law and its internal grievance procedure.

29. MODIFICATION OF SERVICES AND TERMS

29.1 LegalParihar may modify, discontinue or introduce services from time to time.

29.2 LegalParihar may amend these Terms where reasonably necessary to reflect changes in law, services, technology, business practices or regulatory requirements.

29.3 The updated Terms shall be published on the website with the revised effective date.

29.4 Unless otherwise required by law, changes shall apply prospectively to transactions placed after the revised Terms become effective.

30. SEVERABILITY

If any provision of these Terms is held invalid, unlawful or unenforceable by a competent authority, that provision shall be interpreted or modified to the minimum extent necessary to make it lawful and enforceable, where legally permissible.

The remaining provisions shall continue in full force and effect.

31. WAIVER

Failure by LegalParihar to enforce any provision of these Terms on any occasion shall not constitute a waiver of its right to enforce that provision subsequently.

32. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, applicable Refund/Cancellation Policy, order confirmation, service description, quotation, invoice and any other document expressly incorporated into the relevant transaction, constitute the agreement governing the Customer's use of LegalParihar services.

Where a transaction-specific document conflicts with a general provision of these Terms, the transaction-specific provision shall govern that particular transaction to the extent permitted by applicable law.

33. CUSTOMER ACKNOWLEDGEMENT AND CONSENT

By placing an order, making payment, submitting documents, electronically accepting these Terms or proceeding with a service after being provided these Terms, the Customer confirms that:

  • the Customer has read and understood these Terms;
  • the Customer has provided accurate information to the best of the Customer's knowledge;
  • the Customer authorizes LegalParihar to perform the requested services and, where applicable, coordinate or procure third-party services on the Customer's behalf;
  • the Customer understands that certain services may involve independent professionals or thirdparty service providers;
  • the Customer understands that government authorities, notaries, advocates, stamp vendors and other independent providers may independently accept, reject, modify or impose requirements concerning a requested service;
  • the Customer understands that completion of a service does not guarantee acceptance of a resulting document by every authority or organization;
