Odisha High Court has dismissed criminal proceedings in a case where a consensual relationship was later characterized as rape based on an unfulfilled marriage promise.

In a groundbreaking decision, Odisha High Court, under the jurisdiction of Section 482 of Cr.P.C., has dismissed the criminal proceedings against Manoj Kumar Munda. The complainant, which in this context is the prosecutrix, alleged that the petitioner had an intimate relationship with her under the guise of marriage. "The court noted this was a nine year long relationship that began in 2012, with numerous contradictions to the allegations claiming them to be largely disputes," so saying that "the relationship was consensual."

Background of the Case

The case stemmed when both Manoj Kumar Munda and the prosecutrix met for the first time in 2012 while attending a computer course. With time, they gradually became romantically involved, which was accepted by both their families. After getting a job at the police department, he maintained the relationship.

Eventually, the prosecutrix claimed that she was a victim of physical sexual exploitation and psychological sexual trauma inflicted by her partner on the grounds of false promise of marriage.

The complainant further stated that, while in this relationship, she was administered doses of the contraceptive pill 'Unwanted 72' and went on to attempt suicide.

Contradictions of Claims

Notably in a civil case, the prosecutrix alleged they wedded Samaleswari Temple, Sambalpur on February 3, 2021, and performed traditional customs. Where FIR did not mention this marriage highlights contradictions of her statements.

Manoj insisted both adults bore responsibility and consented to the relationship. He argued non-fulfillment of a marriage should not metamorphosize into a criminal case.

Legal Analysis of the Court

The court meticulously drafted legal aspects and came to the following conclusions:

  1. ✔ Allegations of sexual offenses under section 375 IPC gives a collaborative approach to consent.
  2. ✔ Contested consent, voluntarily and actively withdrawn consent does not amount to rape.
  3. ✔ Supreme Court (ex: Pramod Suryabhan Pawar V. State of Maharashtra, Also State of Haryana vs Bhajan Lal) is known fir endorsing the quashing of FIRs and has set precedent on lack of allegations amounting to crimes.

Sociological Perspective Autonomy

The judgment continues to explore independence of women and progressive thoughts about relationships as well as marriage in sociological context. Guided by feminists Judith Butler and Simone de Beauvoir, the court noted.

  1. Societal perception of marriage needs not be viewed as an obligation.
  2. The choices of women must be enshrined within law.

The Odisha High Court ruled in favor of Manoj Kumar Munda, stating that a failed relationship or unfulfilled marriage promise does not justify criminal prosecution. The court also warned against misuse of legal provisions in personal disputes.

Conclusion

The Odisha High Court has reaffirmed that relationships by consent cannot be criminally prosecuted unless there is evidence of duress or misrepresentation. There can be no automatic recourse of rape based on false promises, nor can dissatisfaction with a person's expectation justify litigation devoid of reason.

The decision enhances the woman's legal right to protection whilst countering frivolous litigation, improves personal rights over legal ambiguities, and encourages thoughtful policy making.
